>>The second mediation attempt between SM Entertainment and EXO members Chen, Baekhyun, and Xiumin (collectively referred to as “CBX”), who are in dispute over contract fulfillment and related matters, has also ended without an agreement.
>>On October 2, the 15th Civil Division of the Seoul Eastern District Court (Presiding Judge Cho Yong-rae) held the second mediation session for the lawsuits filed by both SM and CBX over contract enforcement and settlement payments.
>>Following the breakdown of the first mediation session on September 23, both parties again failed to reach an agreement this time.
>>As a result, the case will now return to the main trial process due to the failure of mediation.
>>Previously, CBX notified SM of the termination of their exclusive contracts in 2023, citing issues such as SM’s failure to properly provide profit settlement data, and filed a complaint with the Korea Fair Trade Commission.
>>Though both sides later reached an agreement to maintain the exclusive contracts, it was decided that the three members would conduct their individual activities independently through a new agency, INB100. However, SM filed a lawsuit against CBX, claiming that the promised 10% share of revenue from individual activities has not been paid.

I hope they get everything they deserve. These companies are disgusting, greedy leeches. They have these incredible artists and just crap on them.

shamelessly copy pasting a comment i saw on pannchoa that explains the issue well imo, for people who are curious :
>- CBX signed a contract in 2023 agreeing to pay SM 10% ip fees. That’s written, black and white.
– For the 5.5% Kakao distribution rate, SM explained to CBX from the start they can’t guarantee it because it depends on Kakao’s own policies, so it never made it into the contract.
>CBX knew the 5.5% Kakao album distribution deal wasn’t written in the contract, signed anyway, then stopped paying the 10% over something that was never promised in writing. Wether SM made that promise is irrelevant (though they did deny making that promise in their june 2024 public statement), because SM is enforcing the written deal, CBX is fighting over a verbal conversation their lawyer failed to secure.
>So no people saying SM is going to probably win are not pinkbloods or bootlickers, they’re just realistic. And that’s without even mentioning them going to MC Mong after SM publically apologized for accusing them of being poached by MC Mong, which didn’t help CBX’s reputation at all.

Maaan. I just got into exo like a day or two earlier and it hurts to think that I’m probably never gonna see the actual exo all together. Sure hope this gets resolved and CBX can promote in Korea w/o a jyj situation. Though about that December comeback…. they’re gonna move forward as six, aren’t they?
……
For one of the biggest boy groups in the world, EXO sure have suffered way too much.
